Terms of Service

By accessing or using DigitalAbbot ("the Platform"), operated by Digit Kimi Tech Private Limited, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

You must be at least 18 years old and have the legal authority to enter into contracts on behalf of your organisation. Use of the Platform on behalf of an entity constitutes acceptance by that entity.

We reserve the right to update these terms at any time. Material changes will be notified via email or in-platform notice at least 14 days before they take effect.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your organisation's internal business purposes.

You may use the Platform for urban planning analysis, construction management, IoT data processing, AI-assisted visualisation, and related activities as described in your subscription plan.

You may not sublicense, sell, resell, or transfer the Platform; reverse-engineer or extract source code; use the Platform to build a competing product; or scrape data in bulk without prior written consent.

Subscription plans are billed monthly or annually as selected at sign-up. Prices are listed in USD and may be subject to applicable taxes in your jurisdiction.

Subscriptions renew automatically unless cancelled at least 48 hours before the renewal date. You will receive a reminder email 7 days prior to each renewal.

Annual subscriptions are eligible for a pro-rata refund within the first 30 days. Monthly subscriptions are non-refundable once the billing cycle has commenced. Enterprise contracts are governed by separate agreements.

You agree not to use the Platform for any illegal purpose, including violating privacy laws, intellectual property rights, or data protection regulations in any jurisdiction.

You must not attempt to gain unauthorised access to any part of the Platform, introduce malicious code, conduct denial-of-service attacks, or interfere with other users' access.

You may not impersonate another person or organisation, provide false information during registration, or misrepresent your authority to use the Platform.

The Platform is provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability.

DigitalAbbot is a decision-support tool. All outputs — including AI-generated plans, sensor analyses, and reports — are advisory only. You remain solely responsible for any decisions made using the Platform.

To the maximum extent permitted by law, Digit Kimi Tech Private Limited shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the fees paid by you in the three months preceding the claim.

All software, algorithms, UI designs, trademarks, and content within the Platform are the exclusive property of Digit Kimi Tech Private Limited or its licensors. Nothing in these Terms transfers any IP rights to you.

You retain full ownership of any data, content, or materials you upload to the Platform. You grant us a limited licence to process this data solely to deliver the service.

Any feedback, suggestions, or ideas you submit may be used by us to improve the Platform without obligation of compensation or attribution.

You may cancel your account at any time from your account settings or by contacting support. Cancellation takes effect at the end of the current billing period.

We may suspend or terminate your access for material breach of these Terms, non-payment, or activities that pose a risk to the Platform or other users, with or without prior notice.

These Terms are governed by the laws of the Dubai International Financial Centre (DIFC). Any disputes shall be resolved by the DIFC Courts. If you are based in the EU, mandatory consumer protections in your jurisdiction also apply.
